hay or está?

Both come out as there is or is, and Spanish will not let you swap them.

The rule

hay says something EXISTS, and what follows is new to the listener: hay un problema. está places something ALREADY KNOWN: el problema está aquí. If you would say a in English, you probably want hay; if you would say the, you want está.
